Illinois Trucking Association Pushes for Change to Law that Has Resulted in Frivolous Lawsuits

That’s why we were interested to learn about the recent efforts by the Illinois Trucking Association to push for a change to a law that they believe has resulted in an increase in these types of lawsuits.

Illinois Trucking Companies Have Had Enough

The Illinois Trucking Association is urging state lawmakers to fix a biometric privacy law that has resulted in more than 1,500 frivolous lawsuits filed by class-action lawyers against businesses. The law, which was intended to protect individuals’ biometric data, has been used to argue that trucking companies have violated the law by collecting biometric data such as fingerprints or facial recognition data from drivers or other employees without their consent.

“BIPA is hurting our industry, and it is making our roads less safe. Likewise, trucking companies that were considering these cameras to improve their safety have now decided against installing these cameras in Illinois because they fear being sued in this state.”

Business leaders argue that the current interpretation of the law is misguided, and that it has resulted in a flood of lawsuits against trucking companies that are both costly and time-consuming to defend. They are urging lawmakers to clarify the law and make it clear that it does not apply to the collection of biometric data from truck drivers or other employees in the course of their employment.
